Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Rivvs LLC ("Company," "we," "us," or "our"), operating as Xenfax, located in Albany, New York. By accessing or using our online fax service at xenfax.com, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our service.

Description of Service

Xenfax provides an online fax transmission service that allows users to send fax documents electronically. Our service includes both pay-per-fax options for guest users and subscription plans for registered users. We transmit your documents to the designated fax number using third-party telecommunications providers.

Eligibility

You must be at least 18 years old and capable of forming a binding contract to use our service. By using Xenfax, you represent and warrant that you meet these eligibility requirements.

User Accounts

When you create an account with us, you must provide accurate and complete information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use
• Ensuring your contact information remains current

Acceptable Use

You agree not to use Xenfax to:

• Send unsolicited faxes, spam, or junk faxes
• Transmit content that is illegal, harmful, threatening, abusive, or defamatory
• Violate any applicable laws, including the Telephone Consumer Protection Act (TCPA)
• Infringe on intellectual property rights of others
• Transmit malware, viruses, or other harmful code
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the service or servers

Fair Use & Prohibited Activities

Xenfax is intended for legitimate personal and business fax communications. We reserve the right to monitor usage patterns and take action against accounts that violate our fair use policy.

Prohibited activities include, but are not limited to:

• Using the service for any illegal, fraudulent, or illicit purposes
• Transmitting documents related to illegal activities, scams, or fraud schemes
• Harassment, stalking, or threatening communications
• Sending faxes containing obscene, pornographic, or exploitative content
• Impersonating another person or entity
• Using the service to facilitate money laundering or financial crimes
• Bulk faxing or automated mass transmissions without prior authorization
• Circumventing usage limits or abusing subscription benefits
• Reselling or redistributing the service without written consent

Violation of this policy may result in immediate account termination without refund, and we may report illegal activities to appropriate law enforcement authorities.

Pricing & Payment

Pay-Per-Fax: Guest users can send individual faxes for $1.00 per fax (up to 10 pages). Additional pages may incur extra charges.

Subscription Plans: Monthly subscription at $9.99/month includes unlimited faxes and a dedicated fax number. Subscriptions automatically renew unless cancelled.

All payments are processed securely through Stripe. Prices are in US dollars and may be subject to change with notice. Refunds are provided at our discretion for failed transmissions that are our fault.

Service Availability & Delivery

While we strive for reliable service, we cannot guarantee 100% uptime or successful delivery of every fax. Fax delivery depends on factors outside our control, including the recipient's fax machine availability, phone line quality, and network conditions. We provide delivery confirmations when available but cannot guarantee receipt by the intended recipient.

Intellectual Property

The Xenfax service, including its original content, features, and functionality, is owned by Rivvs LLC and is protected by copyright, trademark, and other intellectual property laws. You retain ownership of any documents you transmit through our service.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RIVVS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

Indemnification

You agree to indemnify and hold harmless Rivvs LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the service, your violation of these Terms, or your violation of any rights of another party.

Termination

We may terminate or suspend your account and access to the service immediately, without prior notice, for any reason, including breach of these Terms. You may cancel your account at any time through your account settings or by contacting us. Upon termination, your right to use the service will cease immediately.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Albany County, New York.

Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the service after changes constitutes acceptance of the modified Terms.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
